Car hit by lorry and driver is denying liability

If there is no white lines on the road the lorry shouldn't be using it (law statement not mine) so the lorry is responsible even if they weren't. Get after the company owning the lorry.


I'd love to know were this came from. I've been through the highway code many times and endured countless hours of classroom modules for driving lorries and this has never been mentioned. So I'd be pretty confident in saying that its bollocks tbh.

The company won't give a shlt about your wing mirror.

The driver won't give a shlt about your wing mirror.

The police won't give a shlt about your wing mirror.

It's unfortunate, but apart from a face to face appeal with the transport manager or the owner, both of whom will probably ignore you at every opportunity, I don't think your mum will have much luck. Bad mouthing them on Facebook probably won't do much in your favour either.

Just look at jimcupra and that tw@t on here trying to get him sacked. Nothing happened, no one cares.

What a load of nonsense about no white lines. Thousands of roads here have no white lines ! and many that do can be dubious at best

Same thing happened to me about 4 years ago coming out of the Cairnryan ferry terminal. When I confronted them about it, both front and rear escort vehicles tried to brush it off with we saw nothing happen, lorry driver never got out of his cab the whole time. Changed they're attitude very quickly as soon as pointed out the dashcam and the mention of taking it further.
1 phone call to they're manager, and a new mirror fitted by a dealer.

Dashcam for the win every time.

You wouldn't exactly notice knocking somebody's wing mirror off their car, so perhaps he thinks your mum is trying it on (plenty have done).

Just saying....
Unless the unit was turning he bloody hell should do ! Careless driving at its finest if he was straight and done that without noticing imo

Your mum may just be better fixing it herself. I know she shouldn't have to, but it will likely be 50/50 as said, or even if they do admit liability, her insurance company will probably hit her with the non fault accident nonsense that they use to squeeze more money out of people come renewal time.

Definitely give off on their Facebook page though, but it probably won't change a thing.

Playing devils advocate here, but the fact there was front and rear escort vehicles, would that not alert you to stay WELL out of the road?

Always do give them a wide birth, but was stuck at a set of road work traffic lights. First lot came round the bend and passed with plenty of space, unfortunately it was the second group who wanted both sides of the road.

park up across the entrance to their depo then ask to see the manager, the tone will quickly change.
