Further ammo for your friend, who towed it(company) and did the driver have the licence to do so?

Vehicle Immobilisation (clamping) and in this case towing+clamping is a licenced activity under the Security Industry Authority in Northern Ireland, operating unlicenced is worth 6months and/or £5k fine

Just to update, solicitor wouldnt take the case on as its a civil matter, so she is claiming through her own insurance. They will hopefully be able to recoup costs from tow company.

Definitely better with the insurance people, especially if covers legal expenses also.

Though the solicitor’s excuse about not taking the case as it’s a civil matter is lame 🤣. Sounds like they just didn’t want to be involved.

Not enough money in it for solicitor given work involved and value of car (so says wife)

Option 1 go via small claims court online for £130 fee and towing company plus parking company get a letter. No guarantee but given circumstance likely to win. No big cost if you lose but will suck up time.

Option 2 go with insurance, gets everything sorted quick, they will try and recover cost but given value of car it might not be worth their while but push them to try.

Option 2 means it's not worth while doing option 1 as you'll be effectively out no money and not worth doing for difference in insurance renewal costs.

Coming at it from a recovery point of view, some drivers in the big companies aren’t actually recovery men, it’s a part time job for them, they see a car and yank and don’t care, if you get the owner of the trucks it be a different ball game cause they do not want to go to court , I managed to get a locked Volvo out of a 90 degree car parking space with hand brake on and car in gear, turned the car on the spot and onto the back of the truck with no damage or issues, it’s all down to experience and having the right tools,

I’ve seen so many so called recovery drivers make catastrophic balls up it would make you cry, I’m only at it 5 years but I’m a fast learner .

hope you get sorted, it’ll be hard trying to prove they damaged it, the driver who damaged it probably doesn’t work for them anymore
