Issues with claims through AXA, anyone same issues?

Basically a fella overtook stopped traffic at a junction, crossed chevron lines and smashed into my other half as she turned right at a junction.

He is recommended for prosecution to PPS for careless driving after police reviewed the CCTV.

This occurred in January and the service we have received from AXA has been very poor. We have had to chase them up continuously,; anytime they said they would get back to us, they didn't and we had to ring them.

They have told us they will push for a 70/30 split as we should have seen him undertaking this dangerous maneuver....they also said that if he is prosecuted for the offence, will have no bearing on liability at all and 70/30 is all they will go for, or nothing at all....

Same thing happened to me a few years ago ....after a bit of a saga it went 50/50 😡

I hard to fathom how someone can be driving on the wrong side of the road, cross solid line road markings and collide into someone as they turn right and not be 100% liable.....with CCTV covering it and police pushing for a prosecution.

I thought the same,I was turning right,some Cnut came down the hard shoulder(yes a hard shoulder)on my right and ploughed into me And apparently if I had of looked up the hard shoulder I could have avoided a collision ....crazy

Hopefully not the case for your Mrs

that's madness how that isn't totally his fault.
unreasonable to expect her to be looking behind her in a lane where there's only traffic coming from opposite her.
that's AXA off my renewal options.

long story

i had a crash years ago ( not my fault hgv went in to the side off my van ) went threw solicitors police etc 100% the other parties fault

they repaired my van which to me should have been wrote off

i was back and forward to different doctors for months in agony with my stomach i was told i had ulcers / cancer / irritable bowl any thing accept to do with the accident ( basically doctors thought i was just in it for the claim )

then went to there specialist doctor for a medical assessment and he came back with basically i was off work too long to reflect the injuries i had received and basically they told me to get lost and threw me some chicken feed for a claim £800 even tho i had accounts they refused to pay for loss off earnings ( i was self employed at the time and making a fortune labour only ( anything between £120-£250 a day before tax ) they said no way a plumber could be making that sort off money

they wanted to pay out and settle very quick for some strange reason

wasn’t until months later after many trips to the doctor he realised the claim had been settled and i was still in pain he turned up that i had damaged my lower intestine when the seat belt cut in to my stomach by this time it was all to late

I was crashed into by a drunk driver who was on the wrong side of the road. Police attended and arrested the other driver.
I actually had to smash the other drivers front window to get them out, they were that drunk.
My car was written off instantly.
Axa were on the phone to me offering a courtesy car then 5 minutes later they rang me back telling me that they hadn’t determined liability yet.
I hired a car myself and recovered the costs. It pissed me off though. The other driver got convicted and banned.

My fiancée is having a bit of a mare with Hastings Direct after our non fault crash. They don’t phone back, took ages to action the solicitor and keep getting her number wrong. Absolute shambles. I wish I had of just contacted Crash and let them sort it.

Re the apportioning blame thing - it’s in the insurance companies interest to split blame between both parties so they can justify whacking two premiums up instead of one at renewal.

...I wish I had of just contacted Crash and let them sort it.

Can’t recommend crash highly enough, I used them once for a pretty small straightforward claim but they were certainly on the ball and I got the impression they’d be more than fit for even a fairly awkward case

Always feel free to pick up the phone after an accident even for a bit of a steer on how your insurance company will deal with it. 75% of my caseload is cases arising from road traffic accidents and in a past life I acted for some of the major insurance companies as well!
