So say you wanted to sleep in your car after a night out, if you hide the key under a bumper/in wheel well on tyre- could you still be done? you are in the car but not really in charge as theoretically you dont have the key on you

Hide it in a safe place! I've done that with wallets, glasses and keys in the house while hammered and they have remained in that safe place for ever and a day! lol.
You'd end up putting them somewhere absurdly stupid, like taking the oil cap off and winging them in there.

but you have easy access to it, so yeah...
But if the key isnt on you and the police dont know where it is could they still do you? you could for all they know have got a friend to open it and take the key home, or luckily have left it open and not have the key on you

Wouldn’t really make sense....you could open your car but not have the key to start it...?
You would still be liable for being in charge of the car as the belief would be that you’d know where the key was and could start the car if you so decided

If there's no key (to be found) on the person who is in the car the offence can't really be proven can it!

Of course it can, has been many times.
Just coz someone hides the key means they can’t be in charge?
They’ve managed to let themselves into their car, it’s ressonae to believe they m me where the key is

It’s simple really ....is there a ‘likelihood’ of them driving at any stage....
And of course there’s a likelihood they know where the key is if they’re in the car already!
Yes but you don't need the key to be drunk in charge of a car.

Wouldn’t be ideal but if you’ve folding rear seats, sleep in the boot.
Next morning get the bus/lift home.
