i would of thought that the driver in the nissan would have to pay for the damage on the 106- because he/she was the one that bumped into it, and then the 106 driver would have to pay out for your car- because he/she left the handbrake off:confounded:

look, at the end of the day it is not for you or me to decide who is at fault or who should pay it is up to the insurance companies, (unless all 3 of you are going to avoid puttin it through the insurance and agree amongst yourselves)

anyway, just report it to the insurance company and let them sort it out. this is what we pay insurance for! so use it! Esepcially if you are not at fault!

Depending on the cost of repair it might not be to your advantage to put it thru' the insurance company - these things can take ages to settle , and they remove your ncb meantime which means that if this is not settled come renewal time the insurance bill is likely to be several thousand pounds which in theory should be claimable when it is proved it wasn't your fault (which it clearly isn't) but things are never simple when it comes to insurance.
