I was in a minor shunt back at the start of September at the notorious shaftesbury Square junction.

I was coming from donegal pass to go round past laverys.

he was coming from botanic avenue.

anyway, I pulled across slowly and stopped behind the car infront of me.

he came down botanic and into the side of my car. his face down before impact then looked up quickly.... from what I'm told by passengers in my car. also he was a deliveroo driver

initially he had admitted fault, I had gone through crash services... then onto their solicitor of choice.

a payout was agreed for my vehicle.

yesterday I just heard that his insurance isn't paying out and has said the fault lies with me.

though I have had no letter from them.

apparently no CCTV cameras in that area... which I find hard to believe.Halifax unwilling to share footage.

getting to the stage now it was that long ago, I'm not sure what to do.

Police didn't attend seen as no injuries.

I think it's my word against there's.

no witness statements taken, and the way it has been relayed to me is " I've pulled out on him"

If you were stationary behind another vehicle then it can’t be your fault surely?

Id say the other car is saying he pulled across him if he’s hit the side of him…

Id be careful with CRASH …I’d only use them if your case was 100% nailed on because their fees are astronomical and they put the arm in everywhere - you could end up with a decent sized bill if it goes against you..

You should have made a complaint to Police if careless driving against the other car at the time…no chance of getting CCTV or witnesses now…
Best chnave you have is 50/50 maybe?

Ones like that it’s best to use your own insurance - as they need to know if any accidents anyway

Due to the road markings, I can see why they'd take on the fight.

How far back was the damage on the side? You'd have to get an engineer to state that the damage on your car proves you would have been stationary. If you were moving ie: pulled across him, the damage would show it fairly clearly

You can try the police, but yea it’d be too late in all reality for them to do anything. Also, I think they only get involved if there’s an injury caused at the time of the accident. If both parties are ok and don’t require treatment I believe they only give a reference number to say that it’s been recorded as such, but I might be wrong on that.

As for the damage, you need to get an engineer or insurance assessor to look at that to try and determine who is at fault.

When you notified the police did the police ask to speak to the other driver? If yes, did he admit to police he was at fault?

Was he properly insured to do deliveries? A lot of these drivers aren’t - so you might be able to apply a bit of pressure on him to admit fault.

engineer has looked at car and carried out his report.

They'll write that off on you
hasn't been written off.

When you notified the police did the police ask to speak to the other driver? If yes, did he admit to police he was at fault?
I don't believe he spoke with the officer I did. The officer was able to tell me his name and that he did have insurance from me giving his number plate

I've heard of this before, but not sure how I'd find out...

If you have his number I’d be ringing him and saying he was delivering and this will cause him more issues than it’s worth.

There's 100% CCTV at that junction as I've seen footage (at the junction faces up Shaftsbury Square towards Queens), try Belfast City Council I imagine they'd own it. Only problem is if the camera was zoomed or fixed at a different point at the time of impact. Although im not sure what the time frame is for stuff to auto overwrite could be anything from 7 days to 60 days, worth a try anyway

Mate it’s nearly 2 months ago now!
At most CCTV is kept for 30 days.
There’s NO CCTV now that police could get.
He needed to make a complaint of Carrless driving at the time that the Police would have been duty bound to investigate to its fullest inc CCTV.
With no complaints and no injuries Police had no reason or need to go securing CCTV.
It’s done now.
At best he’s get some kind of 50/50 split as to costs

Reading things like this make me glad my car is covered in cameras that record continually!

As already mentioned I would be surprised if he had insurance cover for Hire and Reward as noted by Deliveroo on their website, if you have witness statements to this effect then you could try pushing this angle.
