Looking to settle an argument and Googling has prevailed no definite answers.

What are the fines if you are caught using red diesel in your daily road driven car?

No "I think" or "my mate from Magherafelt says" posts - Facts only please (y)

Think its still £500 first time !!!!! If you pay on the spot ,
If you dont they take the car , charge you the 500 ,
plus they work out how long you.ve owned the car and charge you the difference in fuel duty in that time !!!!!
And they will also charge you for moving and storing the car !!!!!!!

Definately £500 for your first offence plus they guess how much red diesel is in your tank and charge you what it would have cost for normal diesel on top of that.

Next time you're caught it's £1000 plus the cost of normal diesel to cover the amount of red in your tank

And if you're unlucky enough to be caught three times they take the vehicle off you and you don't have a chance to get it back (apparently).

1st offence they CAN take the car there and then and still fine you £500 + duty of fuel in tank and im near sure its jailable now aswell as its tax dodging but id say thats extreme cases.

Cheers folks here's another...

Since its not the police that dip, what would happen if you just drove on ignoring the signal to pull in? Do they have the authority to stop the traffic and do you or do they relay on the willing nature of people to pull in and let them work away?

Yes your right Police are usually present, as they have to stop the traffic.

Saying that im on the roads all over NI every day and its very very rare to see them dipping. Probably only seen dippers about 4 times in my entire 10 years driving. And its never at rush hour times, so if its for the daily commute then your usually safe enough.

this happened to my brother not so long ago and the police weren't present so he drove on as the red 306 had colour coded fuel (y)

Customs usually pass the details on to police for those that don't stop. As red diesel traces stay in the tank even after a few fills of white customs can call with police and take a sample and fine.

This is straight from a customs officers mouth (My father-in-law)

Surely the car would need to be caught on the road tho as taking a sample on private property wouldn't prove anything as it's only illegal to use it on the road?

Apparently.... if the car is taxed then it can't have red diesel in it, no matter if its on or off the road.

I only ever run my van on proper white derv, but I've always wondered what the outcome would be if someone was stopped with green diesel from the South while driving in the North, or if stopped in the South with Northern red stuff???

Yes HMRC do have the power to stop vehicles, although any operations are normally done in-conjunction with Police and other agencies..

It's quite simple, don't drive with illegal derv in your tank and you have nothing to worry about....

And they can take after you and stop you. If you say pull off down a road before you see them. They will follow and nab you.lol.
